# RoHS vs Batteries Regulation scope comparison

RoHS-focused comparison explaining when RoHS applies to EEE, why batteries sit outside RoHS, and what evidence should not be reused without separate battery-law support.

*Side-by-side* *EU*

## RoHS vs Batteries Regulation Side-by-side comparison

RoHS applies to electrical and electronic equipment, including covered cables and spare parts, and restricts Annex II substances by maximum concentration in homogeneous materials.

Use this comparison to avoid blending RoHS duties with battery-law work: the RoHS grounding confirms batteries sit outside RoHS, but it does not support detailed Batteries Regulation obligations.

This comparison is intentionally RoHS-led. It explains what RoHS controls for electrical and electronic equipment, where batteries fall outside RoHS, and which records should stay tagged to RoHS rather than being reused as proof of Batteries Regulation compliance.

## RoHS vs Batteries Regulation: side-by-side comparison

A RoHS-focused comparison for products that include EEE and batteries: what RoHS proves, what sits outside RoHS, and where a separate Batteries Regulation source is needed before making battery-specific compliance claims.

- **RoHS**: Use the RoHS side for EEE scope, Annex II substances and thresholds, exemptions, technical documentation, CE marking, EU declarations, and market-surveillance response.
- **Batteries Regulation**: Use the Batteries Regulation side as a boundary marker only on this page: RoHS grounding confirms batteries are outside RoHS, but only the RoHS battery boundary is sourced here.

| Dimension | RoHS | Batteries Regulation | Operational implication | Sources |
| --- | --- | --- | --- | --- |
| Scope and covered activity | RoHS applies to EEE falling within Annex I categories and uses the EEE definition based on dependence on electric currents or electromagnetic fields for at least one intended function. | The RoHS FAQ states that batteries and accumulators used in EEE are not within RoHS; this page does not source detailed Batteries Regulation scope rules. | Classify the finished EEE under RoHS, then open a separate battery-law scope record for the battery rather than stretching the RoHS conclusion. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[European Commission RoHS 2 FAQ guidance](https://environment.ec.europa.eu/system/files/2021-01/FAQ%20key%20guidance%20document%20-%20RoHS.pdf?ref=sorena.io) - Commission RoHS guidance used for the batteries-out-of-RoHS point, open-scope explanation, CE marking timing, and practical scope questions. |
| Who must act | RoHS names manufacturers, authorised representatives, importers, and distributors as economic operators, with manufacturer duties for design, technical documentation, EU declaration, CE marking, corrective action, and authority cooperation. | The cited RoHS sources support the EEE economic-operator map, not a detailed Batteries Regulation actor map. Treat battery-law ownership as unresolved until a battery-specific source is reviewed. | Assign RoHS duties to the EEE economic-operator owner and assign a separate owner to obtain and maintain battery-law evidence. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests. |
| Trigger or threshold | RoHS is triggered by placing covered EEE on the EU market and by assessing whether its homogeneous materials exceed Annex II maximum concentration values or rely on an exemption. | For batteries, the supported trigger here is only negative: the RoHS file should not be used as the battery-law trigger analysis. | Use intake questions that route the same product to RoHS for EEE substance restrictions and to a separate battery-law review for the battery. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[European Commission RoHS 2 FAQ guidance](https://environment.ec.europa.eu/system/files/2021-01/FAQ%20key%20guidance%20document%20-%20RoHS.pdf?ref=sorena.io) - Commission RoHS guidance used for the batteries-out-of-RoHS point, open-scope explanation, CE marking timing, and practical scope questions. |
| Core obligations | RoHS requires manufacturers to ensure EEE is designed and manufactured in accordance with Article 4, draw up technical documentation, carry out internal production control, draw up an EU declaration of conformity, and affix CE marking when conformity is demonstrated. | Battery-specific design, labelling, due-diligence, waste, or passport duties are not established by the RoHS sources cited here and should be handled in a separate battery-law record. | Build a RoHS action list from Article 4 and Article 7, then add battery-law actions only after a separate Batteries Regulation source review. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[Commission Implementing Decision (EU) 2020/659 on EN IEC 63000](https://data.europa.eu/eli/dec_impl/2020/659/oj?ref=sorena.io) - Official decision publishing EN IEC 63000:2018 as the harmonised standard for RoHS technical documentation. |
| Evidence and records | RoHS evidence should include the EEE scope decision, homogeneous-material assessment, Annex II substance matrix, exemption record where used, supplier declarations, relevant test or assessment evidence, EN IEC 63000 technical documentation, EU declaration of conformity, and change records. | Battery evidence may sit in the same product compliance pack, but this RoHS grounding does not define the battery technical file or record set. | Use a shared index only if each record is tagged as RoHS evidence, battery-law evidence, or background support. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[Commission Implementing Decision (EU) 2020/659 on EN IEC 63000](https://data.europa.eu/eli/dec_impl/2020/659/oj?ref=sorena.io) - Official decision publishing EN IEC 63000:2018 as the harmonised standard for RoHS technical documentation.<br>[European Commission - RoHS harmonised standards](https://single-market-economy.ec.europa.eu/single-market/goods/european-standards/harmonised-standards/restriction-use-certain-hazardous-substances-rohs_en?ref=sorena.io) - Commission RoHS harmonised-standards page for the OJEU reference to EN IEC 63000 technical documentation. |
| Timing and cadence | RoHS timing includes the market-placement point, 10-year availability of technical documentation and EU declarations for relevant economic operators, exemption renewal applications no later than 18 months before expiry, and review when standards, design, or suppliers change. | Do not infer Batteries Regulation application dates or transition periods from the RoHS folder. | Track RoHS release and retention dates separately from any battery-law milestones obtained from battery-specific sources. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[European Commission - RoHS Directive implementation](https://environment.ec.europa.eu/topics/waste-and-recycling/rohs-directive/rohs-directive-implementation_en?ref=sorena.io) - Commission implementation page for RoHS exemptions, renewal handling, and assessment studies. |
| Enforcement or assurance route | RoHS non-conformity can require corrective measures, withdrawal or recall where appropriate, notification to competent national authorities, and cooperation with authority requests for information and documentation. | Battery-law enforcement routes need a battery-specific source before they are added to the product compliance plan. | Authority-response playbooks should run two tracks: RoHS track for EEE-substance CE/DoC and Article 7 technical-control issues, and a separate Batteries Regulation track for battery claims, battery waste, and battery-duty questions. Escalate battery-law inquiries to a designated battery-law owner and only proceed to authority communication after that owner confirms source-linked battery evidence. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[Regulation (EU) 2019/1020 on market surveillance](https://eur-lex.europa.eu/eli/reg/2019/1020/oj/eng?ref=sorena.io) - EU market surveillance source for authority checks, cooperation, corrective measures, and penalties under Union harmonisation legislation. |
| Overlap and reuse | RoHS can reuse supplier and material evidence only where it demonstrates the RoHS Article 4 substance conclusion for the covered EEE, component, cable, or spare part. | Battery-law teams may reuse supplier information as background, but this page cannot say that RoHS declarations satisfy Batteries Regulation duties. | Avoid customer-facing statements that say a RoHS declaration proves battery compliance; state the RoHS conclusion and cite a separate battery source for any battery claim. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[European Commission RoHS 2 FAQ guidance](https://environment.ec.europa.eu/system/files/2021-01/FAQ%20key%20guidance%20document%20-%20RoHS.pdf?ref=sorena.io) - Commission RoHS guidance used for the batteries-out-of-RoHS point, open-scope explanation, CE marking timing, and practical scope questions.<br>[Commission Implementing Decision (EU) 2020/659 on EN IEC 63000](https://data.europa.eu/eli/dec_impl/2020/659/oj?ref=sorena.io) - Official decision publishing EN IEC 63000:2018 as the harmonised standard for RoHS technical documentation. |
| Practical decision rule | Proceed under RoHS when the immediate question is EEE scope, Annex II substance limits, exemptions, CE marking, EU declaration, technical documentation, or market-surveillance evidence. | Proceed under a separate Batteries Regulation review when the question is about the battery itself, battery waste, battery-specific documentation, or battery-specific market duties. | For combined products, run both workstreams only after confirming the RoHS EEE boundary and obtaining battery-specific source support for battery duties. | [Directive 2011/65/EU on restriction of hazardous substances (RoHS)](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02011L0065-20250101&ref=sorena.io) - Binding RoHS source for EEE scope, Article 4 substance restrictions, homogeneous-material thresholds, economic-operator duties, EU declarations of conformity, CE marking, and authority requests.<br>[European Commission RoHS 2 FAQ guidance](https://environment.ec.europa.eu/system/files/2021-01/FAQ%20key%20guidance%20document%20-%20RoHS.pdf?ref=sorena.io) - Commission RoHS guidance used for the batteries-out-of-RoHS point, open-scope explanation, CE marking timing, and practical scope questions. |

### How should teams separate RoHS and Batteries Regulation work?

- Start with the RoHS EEE question: category, exclusion, homogeneous materials, restricted substances, exemptions, technical documentation, and CE/DoC evidence.
- Treat batteries as outside the RoHS conclusion and open a separate source-linked battery-law record before making Batteries Regulation claims.
- Reuse evidence only when the record explicitly supports the law named in the customer statement, release gate, or authority response.

## What this RoHS comparison can and cannot prove

RoHS is a sector-specific EEE law. It applies to electrical and electronic equipment in Annex I categories and, where covered, to cables and spare parts for repair, reuse, functional updates, or capacity upgrades. Its substance limits are assessed at homogeneous-material level against Annex II.

The RoHS guidance answers the battery boundary narrowly: batteries and accumulators used in electrical and electronic equipment are not within RoHS. That is enough to stop a RoHS technical file from being treated as a complete battery-law file, but it is not enough to describe detailed Batteries Regulation duties.

- Use RoHS for EEE scope, Annex II restricted substances, homogeneous-material thresholds, exemptions, CE marking, EU declaration of conformity, and technical documentation.
- Route battery-specific obligations to a separate battery-law review instead of deriving them from RoHS sources.
- When a product contains both EEE and a battery, keep one evidence index but tag each record to the law it actually supports.

## RoHS evidence that should stay distinct from battery evidence

For RoHS, the reviewer needs to see the finished EEE scope decision, the homogeneous materials assessed, the Annex II substance matrix, any Annex III or IV exemption relied on, and how conformity was demonstrated before CE marking and the EU declaration of conformity.

EN IEC 63000 is the harmonised standard reference for RoHS technical documentation. It helps structure material, component, and supplier evidence for restricted-substance assessment; it does not turn a RoHS evidence file into a battery compliance file.

- Keep BOMs, material declarations, supplier declarations, exemption justifications, screening or test reports, and change-control records with the RoHS technical documentation.
- Keep the EU declaration of conformity and technical documentation for the RoHS retention period required of manufacturers, and keep importer and authorised-representative availability duties separate from supplier collection tasks.
- Add a boundary note for products with batteries: RoHS evidence supports the EEE substance restriction conclusion only; battery-specific claims need their own source-linked record.

## Use this RoHS comparison as a boundary check

Separate RoHS EEE substance evidence from battery-law evidence before release, supplier review, customer assurance, or authority response.

- [Talk through implementation](/contact.md): Review the RoHS boundary, evidence model, source gaps, and next actions for products that include batteries.

## Practical intake questions for products with batteries

The useful decision is not whether one law replaces the other. It is whether the product contains covered EEE, whether the battery itself is being assessed under a separate battery-law source, and which team owns each file before release, customer assurance, or authority response.

Ask these questions at product intake, supplier change, material change, exemption review, and customer-documentation request stages so evidence reuse stays controlled.

- Is the product EEE under RoHS, and is any Article 2 exclusion being claimed?
- Which homogeneous materials, components, cables, or spare parts are covered by the RoHS assessment?
- Is the battery claim limited to the RoHS boundary point, or does it require a separate Batteries Regulation source and owner?
- Which documents support RoHS conformity, and which documents are only useful background for the battery workstream?
- What change would reopen the RoHS file: supplier substitution, material change, exemption expiry, harmonised-standard change, test result, recall, or authority request?
