# EU GPSR Applicability Test

A step-by-step EU GPSR applicability test for Regulation (EU) 2023/988: confirm whether your products are covered, whether exclusions apply.

*Scope* *EU*

## EU GPSR Applicability Test

A decision-grade scoping test: covered product, exclusion, channel, and role.

Outcome: which GPSR workflows you must implement (documentation, notifications, recall readiness).

Use this applicability test to produce a reproducible decision: in scope / out of scope / partially in scope (GPSR complements sector rules). Document your answers and evidence links-this is what authorities and partners ask for when product safety is questioned.

## Step 1 - Identify the product and the consumer context

GPSR is centered on products made available to consumers. The tricky cases are products designed for professional use that later reach the consumer market, and mixed-use products.

Write down a plain-language intended use statement and the expected user population.

- What is the product category and intended use (consumer / professional / mixed)?
- Does the product reasonably end up with consumers (secondary market, resale, rental, services)?
- What are the key hazards across the lifecycle (design, manufacturing, distribution, use, end-of-life)?

## Step 2 - Check exclusions and sector-rule overlap

Don't treat exclusions as assumptions. You need a traceable rationale: what is excluded, and which legal framework governs instead.

Many real products are 'partial overlap': sector rules govern core specs, but GPSR still drives operational duties (monitoring, corrective actions, recall execution).

- Is there sector-specific EU product legislation covering the product's key risks?
- If yes: what risks/processes remain that GPSR still influences (recall comms, notification workflows)?
- Do you sell used/repaired/reconditioned goods, and can you evidence safety checks and traceability?

## Step 3 - Map channel + role (this changes obligations)

GPSR obligations are role-aware. The same company can hold multiple roles across products and channels (manufacturer for one line, importer for another, distributor in some markets).

Treat this as an operating model problem: build a RACI map and assign evidence owners.

- Which economic operator role(s) apply for this product and channel?
- Is the product offered via an online marketplace (additional operational obligations and interfaces)?
- Who owns: risk assessment, documentation, notifications, listing removal, recall execution?

## Step 4 - Output: pick your path + evidence inputs

Your result should be a short decision memo with evidence links, not a vague conclusion.

If you are in scope, the minimum viable program is: safe product controls + documentation + incident/recall readiness + Safety Gate notification capability.

- Outcome A: out of scope - documented exclusion + alternate framework + review triggers.
- Outcome B: in scope - implement requirements, role duties, documentation/traceability, Safety Gate workflow, recall readiness.
- Outcome C: partial overlap - implement GPSR operational workflows while sector rules govern core product specs.

*Recommended next step*

*Placement: after the applicability result*
