- GPSR applies to products placed on or made available on the Union market (including by distance selling) where there are no specific Union safety rules for the product, or only for aspects and risks not covered by those rules (Art. 2(1)).
- It covers new, used, repaired and reconditioned products (Art. 2(3)).
- 'Product' includes items supplied for consideration or free of charge (including in the context of a service) that are intended for consumers or are likely to be used by consumers under reasonably foreseeable conditions (Art. 3(1)).

## Reference Information

### Product Scope (Overview)

- GPSR applies to products placed on or made available on the Union market where there are no specific Union safety rules for the product, or only for aspects and risks not covered by those rules (Art. 2(1)).
- It covers new, used, repaired and reconditioned products (Art. 2(3)).
- For online and other distance sales, a product is considered made available on the market when the offer is directed to consumers in the Union (Art. 4).
- If a product is subject to Union harmonisation legislation with specific safety requirements, GPSR applies only to the aspects and risks not covered by those requirements (Art. 2(1)).

### Key Exclusions

- Art. 2(2) exclusions include: medicinal products; food; feed; living plants and animals (including certain GMOs); animal by-products; plant protection products; certain transport means operated by a service provider; certain low-risk aircraft; and antiques.
- GPSR does not apply to products that must be repaired or reconditioned prior to use when they are placed on the market as such and are clearly marked as such (Art. 2(3)).

### General Safety Requirement

- Economic operators may place on the market or make available on the market only safe products (Art. 5).
- A safe product is a product that, under normal or reasonably foreseeable conditions of use, does not present any risk or only minimal risks that are acceptable and consistent with a high level of protection of consumers' health and safety (Art. 3(2)).
- Key factors for assessing product safety include product characteristics, presentation and labeling (including warnings and instructions), user categories (especially vulnerable consumers), foreseeable interaction with other products, cybersecurity features, and evolving/learning functions where relevant (Art. 6(1)).

### Risk Assessment

- Before placing products on the market, manufacturers must carry out an internal risk analysis and draw up technical documentation (Art. 9(2)).
- Product safety assessment considers, among other factors, characteristics, labeling and warnings, foreseeable use and user categories, and (where relevant) cybersecurity and evolving or learning functions (Art. 6(1)).
- The Safety Gate framework includes a risk assessment methodology (Delegated Reg. (EU) 2024/3173, Annex II) and supporting tools such as SAGA (Safety Gate risk Assessment).
- Serious risk means a risk that, based on a risk assessment, requires rapid intervention by market surveillance authorities (Art. 3(5)).
- A dangerous product is a product that is not a safe product (Art. 3(3)).

### Traceability Requirements

- Manufacturer identification and product identification elements (e.g., type, batch or serial number) must be provided as required (Art. 9(5)-(6)).
- Importer identification and contact details must be provided as required (Art. 11(3)).
- If a product requires a responsible person in the Union, that economic operator's name and contact details must be provided as required (Art. 16(3)).
- Economic operators must be able to identify their suppliers and customers and provide traceability information to authorities for required periods (Art. 15(3)-(5)).
- For distance sales, product offers must include required manufacturer/responsible person information, product identifiers, and warnings/safety information (Art. 19).

### Recall and Corrective Actions

- If a manufacturer considers or has reason to believe a product it placed on the market is dangerous, it must take corrective action (including withdrawal or recall), inform consumers, and notify authorities via the Safety Business Gateway (Art. 9(8)).
- Importers and distributors have corresponding duties to take action and ensure consumers and authorities are informed when they identify dangerous products (Art. 11(8) and Art. 12(4)).
- In case of a product safety recall or a safety warning, economic operators and online marketplace providers must directly inform affected consumers where they can be identified, and otherwise use appropriate channels to maximize reach (Art. 35).
- Written recall communication must follow the recall notice requirements, including the heading 'Product safety recall', product identification, risk description, consumer actions, remedies, and contact channels (Art. 36). The Commission sets a template via implementing acts (Implementing Reg. (EU) 2024/1435).
- Consumers must be offered effective, cost-free and timely remedies (repair, replacement, or refund), with at least two options where possible (Art. 37).

### Online Marketplace Specific Obligations

- Designate contact points for authorities and consumers and register the authority contact point with the Safety Gate Portal (Art. 22(1)-(2)).
- Maintain internal procedures to comply with GPSR requirements without undue delay (Art. 22(3)).
- Comply with authority orders to remove/disable access to content relating to offers of dangerous products, typically within two working days, and notify the authority of compliance (Art. 22(4)-(5)).
- Ensure listings include required manufacturer and responsible person information, product identifiers, and warnings/safety information (Art. 22(9)-(10)).
- Support recalls and safety warnings (including directly informing affected consumers where possible) and notify authorities via the Safety Business Gateway when you have actual knowledge of dangerous products offered on your marketplace (Art. 22(12)(a)-(d)).
- The Safety Gate Portal includes an interoperable interface for online marketplaces; implementing rules are set by Implementing Reg. (EU) 2024/1459 (Art. 34(5)-(6)).

### Safety Gate (RAPEX) Notification

- The Commission develops and maintains the Safety Gate Rapid Alert System for exchanging information on corrective measures related to dangerous products (Art. 25).
- Member States notify corrective measures via Safety Gate, including measures related to products presenting a serious risk (Art. 26).
- Implementing Reg. (EU) 2024/2639 sets the roles and tasks of the national contact points for Safety Gate (Art. 25(2)).
- Delegated Reg. (EU) 2024/3173 supplements the GPSR with detailed rules on access to and operation of the Safety Gate system and related requirements.
- Commission Implementing Decision (EU) 2019/417 (RAPEX guidelines) is described as obsolete and replaced in Commission Q&A materials.

### Market Surveillance

- Market surveillance for products covered by GPSR is carried out under the EU market surveillance framework (Reg. (EU) 2019/1020), as applied by Art. 23 GPSR.
- Member States must report on the application of the GPSR, and the Commission publishes an annual summary report. The output indicators are set via implementing acts (Art. 24; Implementing Reg. (EU) 2024/2958).
- Selected information on dangerous products and measures is made publicly available via the Safety Gate Portal (Art. 33(1) and Art. 34).
- Consumers and other parties can inform the Commission about products that may present a risk via the Safety Gate Portal; modalities are set via implementing acts (Art. 34(3)-(4); Implementing Reg. (EU) 2024/1740).

### Penalties and Enforcement

- Member States must lay down rules on sanctions for infringements of GPSR obligations and take measures to ensure they are implemented (Art. 44(1)).
- Sanctions must be effective, proportionate and dissuasive (Art. 44(2)).
- Member States must notify the Commission of their sanctions rules and measures by 13 December 2024 (Art. 44(3)).
- The Commission must evaluate the implementation of the sanctions article by 13 December 2029 (Art. 47(5)).

### Responsible Person in EU

- A product covered by GPSR may not be placed on the market unless there is an economic operator established in the Union responsible for the tasks referenced in the market surveillance framework (Art. 16(1) and Reg. (EU) 2019/1020 Art. 4(3)).
- The responsible economic operator must, where appropriate, carry out regular checks related to technical documentation and identification and safety information requirements (Art. 16(2)).
- The responsible economic operator's name and contact details (including postal address and electronic address) must be provided on the product, its packaging, the parcel, or an accompanying document (Art. 16(3)).

### Standards and Presumption of Conformity

- Products are presumed to comply with the general safety requirement where they comply with applicable European standards (or parts of standards) covering the relevant risks, or (in absence of such standards) with certain national requirements (Art. 7(1)).
- The Commission can adopt implementing acts to set specific safety requirements to be covered by European standards (Art. 7(2)).
- Where presumption does not apply, additional elements can be considered for the safety assessment, such as other standards, international standards, and Commission guidance (Art. 8).

### Technical Documentation and Record-Keeping

- Manufacturers must draw up technical documentation that includes at least a general product description and essential safety-relevant characteristics, and keep it available for 10 years after placing the product on the market (Art. 9(2)-(3)).
- Technical documentation can include (as appropriate): risk analysis, test reports, and the standards or other elements used to meet the general safety requirement (Art. 9(2)).
- Importers must keep a copy of the technical documentation for 10 years and provide it to authorities on request (Art. 11(6)).

### Consumer Information and Reporting

- Consumers and other parties can inform the Commission about products that may present a risk via a dedicated section of the Safety Gate Portal, and the Commission can transmit verified information to Member States for follow up (Art. 34(3)).
- The Commission sets the modalities for consumer information submissions and transmission to national authorities via implementing acts (Art. 34(4); Implementing Reg. (EU) 2024/1740).
- Consumers can also submit complaints to competent national authorities about product safety, surveillance activities, and inadequate recall remedies, and authorities should follow up appropriately (Art. 33(4)).
- In case of recalls and safety warnings, economic operators and online marketplace providers must inform affected consumers where possible and otherwise use appropriate channels to maximize reach (Art. 35).

### Authorised Representative

- An authorised representative is a natural or legal person established in the Union with a written mandate from the manufacturer to perform specific tasks under the Regulation (Art. 3(9)).
- The written mandate defines the tasks performed and must be made available to market surveillance authorities on request (Art. 10).
- Authorised representatives can be part of the economic operator chain and may also serve as the responsible economic operator in the Union where applicable (Art. 16).

### Cybersecurity and AI Features

- Product safety assessment considers cybersecurity features where required by the nature of the product, including protection from external influences (including malicious third parties) where such influence could affect product safety (Art. 6(1)(g)).
- Where relevant, safety assessment also considers evolving, learning and predictive functions of a product (Art. 6(1)(h)).
