## EU Batteries Regulation (Regulation (EU) 2023/1542) FAQ

This FAQ focuses on operational questions that come up during product launch, procurement, and portfolio review. Dates are stated explicitly because the Batteries Regulation is phased and the wrong date is one of the most common sources of implementation error.

## When does the Regulation apply?

The Regulation applies from 18 February 2024, except where Article 96 or specific provisions set a later date. Article 14 state of health and Chapter VI timing start from 18 August 2024. Chapter VIII due diligence starts from 18 August 2025. Article 11 removability, Article 13 QR marking, and Article 77 battery passport start from 18 February 2027 for the relevant cases.

## Which batteries need a battery passport?

From 18 February 2027, each LMT battery, each industrial battery with a capacity greater than 2 kWh, and each electric vehicle battery placed on the market or put into service must have a battery passport. Portable batteries and SLI batteries do not fall into the Article 77 passport requirement unless another rule changes the picture.

## Which batteries need state of health and expected lifetime data?

From 18 August 2024, up to date Annex VII parameter data must be contained in the battery management system of stationary battery energy storage systems, LMT batteries, and electric vehicle batteries. Read only access must be provided on a non discriminatory basis to the legally permitted actors for the listed purposes in Article 14.

## How does Article 11 removability actually work?

Article 11 applies from 18 February 2027. Products incorporating portable batteries must allow the batteries to be readily removable and replaceable by the end user, subject to the listed derogations and exclusions. Products incorporating LMT batteries must allow the batteries and individual cells in the battery pack to be readily removable and replaceable by an independent professional. Spare parts availability for portable and LMT batteries lasts at least five years after the last unit of the equipment model is placed on the market.

## When does battery due diligence start?

Battery due diligence obligations start from 18 August 2025. Economic operators in scope must set up and implement a due diligence policy, have it verified and periodically audited by a notified body, keep evidence for 10 years after the last covered battery is placed on the market, and publish an annual public report.

## What collection targets should producers know?

Portable battery collection targets are 45 percent by 31 December 2023, 63 percent by 31 December 2027, and 73 percent by 31 December 2030. LMT battery collection targets are 51 percent by 31 December 2028 and 61 percent by 31 December 2031. These are producer responsibility obligations and require actual collection systems and reporting.

## What are the main recycling and recycled content milestones?

Recycling efficiency targets apply by 31 December 2025 and rise by 31 December 2030. Material recovery targets for cobalt, copper, lead, lithium, and nickel apply by 31 December 2027 and rise by 31 December 2031. Article 8 recycled content disclosure for certain categories starts from 18 August 2028 and minimum recycled content shares start from 18 August 2031, with higher levels from 18 August 2036 and later coverage for LMT batteries.
