## China Telecom and Wireless FAQ

Use separate decisions for telecom network access, radio equipment, radio station deployment and preinstalled apps. A connected product can trigger more than one route.

Start with the finished model's public-network function, transmitters, frequency bands, antenna, power, deployment and software. Then use the focused answers below to build the required evidence.

There is no single China approval for every connected device. A review covers separate decisions for telecom equipment network access, radio transmitting equipment model approval, any radio station licence tied to deployment, and mobile smart terminal app duties. These routes use different scope tests, and a product can need several of them. A covered manufacturer must list preinstalled apps in the product instructions and show, in the instructions or on the outer packaging, how users can find detailed app information. The disclosed information includes the app name, function, uninstall method, developer, required permissions, and the content, purpose, method, and scope of personal-information collection and use.

- From 1 January 2023, basic-function software is limited to system settings and file management; multimedia capture; calls, text messages, contacts and browser; and the app store. At most one preinstalled app for each basic function may be non-uninstallable.
- All other preinstalled apps must have a safe and convenient uninstall method. Associated resource, configuration and user-data files must also be removable when removal does not impair safe terminal use.
- The manufacturer must prevent a user-removed preinstalled app from being forced back during an operating-system upgrade and must take measures against operating-system replacement or unauthorized app installation in distribution channels.

Do not assign every obligation to the device maker. An app-distribution platform must register provider, operator and developer identity and contact details; review and test apps; monitor and remove unlawful or malicious apps; disclose requested permissions and their purposes; and operate complaint handling. It must retain the distributed app and version, release time, function, purpose, MD5 checksum and server-access information for at least 60 days.

- Manufacturer file: model and software-build identifier, controlled preinstalled-app inventory, app-detail disclosure, user notice and consent flows, uninstall tests, upgrade non-restoration tests, and channel-control measures.
- Network-access file: the declaration supplied with the mobile-terminal application, evidence that preinstalled software is consistent before and after approval, and the decision and record for any newly added app or major functional change reported to MIIT.
- Platform or billing file, where that role exists: provider identity checks, review and monitoring results, permission disclosures, takedown and complaint records, 60-day traceability data, and five-month billing records.

Start with the product's intended network connection and function. Telecom terminal equipment connects at the end of a public telecom network; radio communication equipment connects to that network by radio; interconnection equipment supports interconnection between different operators' networks or different telecom-service networks. Then match the exact finished equipment name to MIIT's current directory.

- Identify the finished model, its user and network interfaces, the public network it will access, and whether it performs a terminal, radio-communication or interconnection function.
- Record the exact current MIIT directory name, applicable standards and the source date used for the classification.
- Check the 2023 additions and removals. Satellite internet equipment and functional-virtualization equipment entered licensing; the 11 named legacy categories left new permit approval.
- If there is no clear directory match, obtain a product-specific classification from the responsible MIIT channel before testing or launch.

A covered model needs MIIT approval before it is connected to a public telecom network or sold in China. The ordinary result is a network access permit. New telecom equipment that is regulated but lacks a formal national or industry standard may follow the network trial approval route; the 2023 reform gives that approval a two-year validity period.

- Keep the scope memo tied to the model, hardware, software, radio modules, antennas and intended public-network connection.
- Retain the directory entry, test plan and reports, application version, receipts and corrections, expert-review file if used, final permit or trial approval, and licence validity.
- Assess radio transmitting equipment model approval and any station licence separately. A network access permit does not decide radio compliance, and a module's radio approval does not decide the finished product's network-access status.
- Reassess a change to main functions, core components or licence information. The 2023 product-family reform allows online filing for narrower changes that do not alter main functions or core components.

For network access, identify the public-network connection and match the finished product to MIIT's current equipment directory. A permit or trial approval belongs to the listed telecom model, not automatically to every device containing an approved communications module.

- Network access output: directory classification, applicant, test and application file, permit or trial approval, mark and model-change controls.
- Radio equipment output: transmitter and band inventory, technical-rule assessment, model approval or exact micro-power catalogue rationale, and antenna or power-change controls.
- Deployment output: a separate radio station licence decision based on location, indoor or outdoor use, station type and radiated power.
- Keep the identifiers and approved configurations separate. One approval is not evidence that the other route is satisfied.

A radio model approval addresses the equipment design. A radio station licence addresses setting up and using a station in a particular deployment. Under the 2021 rules for the 2400MHz and 5800MHz bands, a station licence is required for a wireless LAN access point, broadband wireless access centre station or point-to-point station only when it is outdoors and exceeds the stated equivalent isotropically radiated power threshold: more than 20 dBm at 2400MHz or more than 30 dBm at 5800MHz.

- Product file: finished-model block diagram, module integration, transmit bands, output power, antenna type and gain, firmware controls, model approval or micro-power rationale.
- Network file: public-network purpose, current MIIT directory classification, permit status and approved model configuration.
- Deployment file: station type, coordinates, indoor or outdoor setting, EIRP calculation, satellite-earth-station distance where relevant, station licence decision and operator.
- Change trigger: reassess hardware, firmware, antenna, power, band, network function or deployment changes against all three records.

The 2400MHz band supports broadband wireless access including WLAN, Bluetooth and point-to-point links. The 5100MHz band supports broadband wireless access but is limited to indoor use and excludes use inside automobiles. The 5800MHz band supports broadband wireless access, point-to-point links and electronic toll collection. No station or device has exclusive use of these shared bands.

- Equipment in 5250-5350MHz must use dynamic frequency selection (DFS) with no disable option and transmit power control (TPC) with a range of at least 6 dB. Without TPC, both EIRP and EIRP spectral-density limits are reduced by 3 dB.
- Equipment in all three bands must meet one of the interference-avoidance methods in Annex 2. The official interpretation describes listen-before-talk, monitoring and avoidance, or an equivalent occupancy rate no greater than 10 percent.
- A WLAN device that assigns public-network IP addresses must support IPv6 and enable IPv6 address assignment by default. Since 1 December 2023, the model-approval test also checks IPv6 capability; the product must retain a user configuration option and explain configuration in its instructions. This condition does not apply merely because a product has Wi-Fi.
- Equipment subject to special national information-security requirements must also meet the GB 15629 WLAN air-interface access-control security series.

A wireless LAN access point, broadband wireless access centre station or point-to-point station needs a provincial radio station licence only when it is outdoors and its EIRP is more than 20 dBm in 2400MHz or more than 30 dBm in 5800MHz. Other equipment and stations in the three bands do not need a station licence under this notice. A 5100MHz station must remain more than 3 km from a lawfully used same-band satellite radionavigation or fixed-satellite earth station operating in the space-to-Earth direction.

- Retain the approved band, channel, power, antenna, RF-unit integration, multi-antenna calculations, unwanted-emission results and selected interference-avoidance method for the finished model.
- For 5250-5350MHz, retain DFS tests showing there is no disable option and TPC evidence, or the reduced-limit test results for equipment without TPC.
- For WLAN equipment with public IP address assignment, retain IPv6 support and default-enable evidence; record why the condition does not apply where that function is absent.
- For each deployment, record indoor or outdoor use, station type, EIRP, coordinates, any 5100MHz satellite-earth-station separation check, and the station-licence conclusion.
- For a legacy model, retain the approval or extension application date, certificate validity and evidence that supports continued manufacture, import, sale or use under the transition.

Use the current equipment-directory entry to confirm the product name, applicable standards, required test scope and whether expert review applies. Do this before commissioning tests because a marketing name or radio module approval does not establish the finished product's network-access category.

- Application and legal identity: the official application form; the domestic applicant's business licence, or the foreign applicant's registration record; and, for a foreign applicant, the Chinese agent's licence and authorization letter.
- Organization and quality: an applicant profile covering production conditions, instruments, quality assurance and after-sales measures; records for any legally required repair, replacement and return responsibilities; and the manufacturer's quality-system certificate or qualifying audit report.
- Product and conformity: functions, performance indicators, block diagram, internal and external photographs, instructions, and a test report or product certification certificate from a recognized qualified body.
- Conditional trial file: for wireless communication, interconnection or new telecom equipment, the overall technical plan and the trial body's report covering at least three months of network testing.

Retain the submitted version of every document, the online receipt, any correction request and response, expert-review materials when MIIT uses that process, the decision, and the final licence or trial approval. The statutory service guide states a 60-day decision period after receipt of an application, with expert review taking up to 45 days outside that period. MIIT's 2023 reform separately states a 15-working-day administrative commitment after acceptance, except where a lawful reason prevents it; plan around the official case status rather than treating either period as a guaranteed launch date.

- Link every test sample, report, photograph, software version, antenna and hardware configuration to the exact model submitted.
- Record why a network trial and expert review do or do not apply, with the current directory entry used for that decision.
- Keep the licence or trial approval, new network-access mark approval and associated data, public query result, expiry date, and renewal or change filings.
- Treat the 2023 reforms as controlling where the older service-guide wording differs: trial approvals now have a two-year validity period, and qualifying product-family changes use online filing.
